Suspected of being drunk, a lawyer in Mykolaiv turned out to be wanted for evasion and was sent to the military enlistment office (video).

In Mykolaiv, police received a report about a driver of a Subaru vehicle who was likely under the influence.

This was reported by the patrol police of the Mykolaiv region.

The car was stopped based on a description, and the law enforcement officers explained the situation to the driver, proposing that he undergo a sobriety test at a medical facility.

“The man informed the police that he was a lawyer. Subsequently, his lawyer and wife arrived at the scene, after which everyone went to the medical facility for further examination. The medical conclusion established that the driver was not under the influence of alcohol or drugs,” - the statement said.

However, during the document check, it was discovered that the driver was wanted under Article 210 (Violation of the legislation on military duty and military service by military personnel or conscripts) of the Code of Ukraine on Administrative Offenses.

“We inform you that in the event of an offense under Article 210 of the Code of Ukraine on Administrative Offenses, the law does not provide a special procedure for detaining a lawyer. However, if a citizen, including a lawyer, refuses to comply for the preparation of administrative materials, the police may apply administrative detention in accordance with Article 260 of the Code, but strictly in accordance with the law. Thus, we suggested that the citizen proceed to the RTC and SP. However, the man refused, and his wife attempted to provoke a conflict,” - reported the police.

It is noted that the patrol officers eventually delivered the citizen to the Central RTC and SP without the use of special means. His lawyer was present throughout the process.

The patrol officers drew up a protocol for administrative detention against the man, while the RTC and SP staff completed a protocol under Article 210 of the Code of Ukraine on Administrative Offenses.

“To verify the legality of the police actions, the leadership of the patrol police in the Mykolaiv region has initiated an internal investigation,” - concluded the patrol police.
