The Central District Court of Mykolaiv continues to hear the case regarding the "knife fight," with the accused being Andriy Nevenchany, the brother of a former city council deputy. During the session, the prosecutor requested an extension of the preventive measure for the defendant.
This was reported by a correspondent from “Novosti-N.”
During the court hearing, the prosecution requested to extend the preventive measure for Andriy Nevenchany, arguing that otherwise, the defendant might evade justice, influence witnesses, and so on. The prosecutor also emphasized that the defendant fled the scene after committing the crime. A representative of the victim's side supported the prosecutor's stance.
In turn, the defense attorneys expressed the opinion that the prosecutor is not taking his duties seriously, merely changing dates in requests for extending the preventive measure while submitting the same document to the court. Additionally, the defense pointed out the incorrect date of the decision regarding the extension of the preventive measure mentioned in the request.
- The defense believes that the prosecutor does not even "bother" to read the decisions of the investigative judge when making a request. This is already the third request in which only the date of submission has changed. He doesn’t even bother to check when the judge made the decision regarding the extension of the detention period in the specified proceedings. In his request, he claims it was November 7, but it was actually November 8… No one but the prosecutor should take their duties very seriously, especially when it concerns a person's life. In this criminal case, we have Article 115, there is a person who was killed – intentionally or accidentally, this will be determined by the court. It is the prosecutor's duty that when he believes the collected evidence is sufficient to draft an indictment, he must do so. That is, it is precisely the prosecutor who should have verified all the materials, on which we spent a lot of time questioning the investigating witness. And it is the prosecutor who should have checked whether there were enough video files to prepare the indictment or if an examination was necessary. But the prosecutor only during the court session, apparently, saw these video files for the first time, according to the defense. Because it was only when he looked at them during the court session that he had the idea to request an expert to conduct an examination. What were you doing during the pre-trial investigation? – said Volodymyr Tymoshyn.
According to the lawyers, the prosecution is trying to delay the case proceedings. Moreover, they believe that the prosecutors did not provide substantial arguments for extending the preventive measure in the form of detention without the right to bail.
The lawyer pointed out to the court that the defendant Andriy Nevenchany left the crime scene to save his wife and child, who were in the car during the fight. After Alexander Tarasyuk was killed and Yuriy Bohomyatkov was injured, other men, friends of the victims, chased after Nevenchany, which, in the defense's opinion, posed a threat to Nevenchany's wife and child. However, after taking his family to Pervomaisk, where they currently reside, he returned to surrender to the police.
At the same time, the prosecutor stated that the defense manipulates the circumstances. According to the prosecution, the defendant himself went to the "Mida" store, approached a group sitting on a bench, and began to inflict bodily harm. The prosecutor also stated that during the pre-trial investigation, Nevenchany did not inform them about the knife he threw into the bushes.
- The defense claims that Nevenchany was defending himself against the unlawful actions of Shvets and others. But they somehow remained silent about the beginning of the conflict when Nevenchany voluntarily arrived at the scene of the crime, approached the group sitting on the bench, and began to inflict bodily harm. Your Honor, at the last court session, the defense told us that during the inspection of the crime scene, the prosecution should have found three knives. We found two, and Nevenchany threw the third somewhere in the bushes. Please note, during the pre-trial investigation, the suspect said nothing about this at all. And we couldn't even have known about it. In fact, the defense has manipulated the circumstances, - said the prosecutor.
As a result, Judge Volodymyr Aleynikov decided to grant the prosecutor's request and extended the preventive measure for the defendant in the form of detention without the right to bail.
As previously reported, during the session at the Central District Court of Mykolaiv, investigator from the Mykolaiv regional police, Olga Z., who wrote the inspection protocols of the crime scene, was questioned. Olga Z. did not deny that she wrote the first protocol, which was long attempted to be deciphered at the last session, and that the second was written by her supervisor, but signed with her initials.
Also, Andriy Nevenchany, suspected of murder during the knife fight outside a store in the Severny district of Mykolaiv, explained what caused the conflict.
The fight occurred near the store on Architect Starov Street around midnight on May 3. During the brawl, two participants sustained knife wounds. One of the victims died at the scene, while the second was hospitalized by an ambulance. Police noted that the perpetrator fled, but was soon apprehended. As reported by “Novosti-N,” the detained individual, Andriy Nevenchany, is a cousin of a former city council deputy. One of the victims in the "knife fight" in Mykolaiv was Yuriy Bohomyatkov, who was in pre-trial detention at the time of the full-scale invasion - he was involved in a extortion case.
In a comment to “Novosti-N,” Judge Volodymyr Aleynikov stated that the deceased was a serviceman who was in pre-trial detention before the full-scale invasion.
